Obama Pressured to Change Faith Based Hiring by Charitable Organizations Receiving Federal Funds
Since 2002 it has been legal for charitable organizations receiving federal funds to discriminate in hiring according to religion. During his election campaign in 2008 Obama said the legislation was inappropriate. Some lawmakers and liberal religious groups are pressuring him to take action to change the legislation.
Per the article:
Asked for comment on Wednesday, a White House spokesman said "the Justice Department continues to examine this issue on a case-by-case basis."

He promised that for a long time. If they're examining it case-by-case, they're probably making a point of ignoring the fact that it violates the First Amendment.
